the US protects free speech quite broadly. clearly kataria et al did not exhort anybody to imminent violence, so their speech is protected. the kkkangress clearly does not know that america is not a banana republic as india is under their misrule, where, for instance, the prime minister happily violates the constitutional guarantee to equal protection under the law regardless of religion by saying in public "mohammedans have first right to india's resources"
(this blog, by the way, is also protected by the first amendment, as it is written on servers belonging to an american company, google, and maintained in america.)
therefore, please contribute to the defense fund. if properly handled, with a countersuit for the following things, it can wipe out the INOC:
a) what locus standi does the chamchas of sonia nehru have? they have not registered themselves as a lobbyist for a foreign prince, as you are required to do if you want to lobby in america. therefore they will be fined for being a fifth columnist for a foreign power
b) libel and mental agony and wrongful lawsuit. they have hurt kataria et al by making false allegations against them
c) violation of constitutional rights. just as the kkk violated the constitutional rights of blacks, the chamchas of sonia nehru are violating the constitutionally-guaranteed first amendment rights of kataria et al
d) an investigation of the funding for the chamchas of sonia nehru can also be demanded, and this can potentially be under the RICO (racketeering and corrupt practices act). like, where did the money for inoc come from? is it funded surreptitiously by a foreign entity like the swiss bank accounts of the kkkangress? that would be another no-no.
i believe that, in proper legal lingo, all these will stand in court. it would be nice to bankrupt the chamchas of sonia nehru (aka indian national overseas congress) if the court in turn, gives kataria et al a $100 million award including punitive damages. in this context, it may be remembered that the ku klux klan was bankrupted and forced to sell its headquarters when the ACLU and the southern poverty law center sued and won against them when they violated the constitutional rights of a black woman.
but it costs a lot of money to engage a top class law firm. so please contribute to the legal defense fund.
