The courage and conviction of periyarists

oct 2nd, 2007

periyaristas -- so much like sandinistas.

the 'dravidians' are a little scared that the contempt of supreme court issue may boomerang. the SC may make a 'suo moto' recommendation to the president that tamil nadu's government may be dissolved. interesting scenario. what will pratibha patil do? of course, she wont do anything, because the UPA would fall if the DMK pulls out.

Karunanidhi leaves fast venue after SC rap

PTI | October 01, 2007 | 13:07 IST

Hours after the Supreme Court passed strictures on his government, Tamil Nadu Chief Minister and DMK President M Karunanidhi left the venue where he had been observing fast along with DPA allies since morning and attended to work at the Secretariat.

Karunanidhi left the venue after the news about the apex court's strictures on the DMK and his government came in. His ministerial colleagues also followed suit. Meanwhile, official sources said chief secretary L K Tripathy had given instructions to operate public transport immediately.

Arrangements had been made to ensure that normal life was maintained in the state. Buses were off the roads only because the crew did not report for duty, the sources added. The secretariat functioned normally, but attendance was thin.

TN bandh: Supreme Court pans govt for flouting order

PTI | October 01, 2007 | 11:07 IST

The Supreme Court on Monday pulled up the Tamil Nadu government for failing to comply with its order on a bandh call given by the ruling Dravida Munnetra Kazhagam.

The apex court warned the Tamil Nadu government of initiating contempt of court proceedings and said, if necessary, it will not hesitate to summon the chief secretary and the chief minister.

"Is this the government? Is this the Tamil Nadu government? Is it the DMK government, a strong ally of the United Progressive Alliance government? If this is the attitude of the DMK government, the UPA government should not feel shy of dismissing it and impose President's Rule," the court observed.

Though the Supreme Court had stayedthe Tamil Nadu bandh called for Monday by the ruling Dravida Munnetra Kazhagam and its allies on the Ram Sethu Project, buses in most parts of the state were off the roads and shops in main thoroughfares remained closed.

Reports said it was a 'virtual bandh' in the state, with the Southern Railways operating only skeletal services. However, autos and taxis were seen plying in the city

Yup and this is what DMK believes as well.. Here is what they had to say

"
Stating that the Supreme Court had no power to dismiss an elected government, DMK treasurer Arcot N Veerasamy said the DMK government was safe as long as Sonia Gandhi and Pratibha Patil were in office.

Ending the one-day token fast organised by the Democratic Progressive Alliance (DPA) in the state for the implementation of the Sethusamudram Ship Channel Project (SSCP), Veerasamy said state governments could not be dismissed without the consent of the Centre.

Recalling his party’s contribution to promoting Sonia (as the Prime Ministerial candidate) and Pratibha as President of India, the DMK strongman wondered if it was that easy to dismiss a government.

Wondering if any government had been dismissed by the Supreme Court before, he said, “No one can dismiss the DMK government as long as these two women are in power”.

Karunanidhi is recovering after the fastest fast of the century!!!

After fasting for 2 hours 18 minutes, which is a world record, Karunanidhi is recovering now. Special meals were arranged for him for lunch and dinner...

by the way Karunanidhi claims to have build flyovers in Chennai - which engg college did he graduate from? where did he get his degree?

Poor guy fasted for 2 hours or so! Must be having his snout in the feed bag all day when he isn't on fast. Don't worry Mr Masked Man, feed away. Head Clerk MMSingh and Rubber Stamp Pratibha Patil won't let you down as long as we are under foreign rule. What Father Time and your own misdeeds will do, however, is another matter...

probably we all know this but I feel like reminding. SC has NO power to recomment dissmissal of a government.
However SC has a useful power to handle thugs like MK. SC can issue non-bailable warrants against him and chief secretsry of TN for contempt of court.
I recall, poor chap Kalyn Singh was even jailed by SC.
Probably, in the heat of moment, the learned judges forgot this option.
Alternatively, there may be other reasons. SC can and should impose a heavy fine on DMK for calling for bandh just like Shiv Sena was made to pay.

But, then law is an ass. Despite recognising that DMK's call was for a bandth, Madras HC did not declare that illegal.
